Urge Labor Regulators to Withdraw Harmful Proposed Rules
BOMA International urges you to contact the National Labor Relations Board (NLRB) and the U.S. Department of Labor (DOL) and ask that they withdraw two proposed rules that would severely limit small business’ ability to properly respond and educate their employees on the pros and cons of unionization. Since ‘card check’ legislation failed to pass Congress, unions are attempting to establish a de facto card check through the regulatory rulemaking process. In coordination with the Coalition for a Democratic Workplace, BOMA International is urging you to write NLRB and DOL and tell them to withdraw these proposed rules. The proposed rule currently before the NLRB could result in an election being held in as little as 10 days after a union files a petition, as opposed to the current median of 38 days before an election. DOL’s proposed rule would eliminate an "advice" exemption from an employer that chooses to hire a third party to advise them on the union organizing process. For more than 50 years, current law has required businesses and third parties they hire to disclose activities intended to influence union organizing to the government; however, current law exempts businesses from reporting the advice they receive from consultants or lawyers. Eliminating that exemption would hamper a businesses’ ability to educate its employees on choosing to unionize. Read the grassroots letters to NLRB and DOL.
